Terms and Conditions of Rigels.io

These Terms and Conditions govern access to and use of the services offered through rigels.io (hereinafter, "the Service"). By purchasing any web hosting plan, you fully accept the conditions described in this document.
Note: These Terms and Conditions are governed by Spanish law and the applicable legislation of the European Union. The legally binding version of this document is the Spanish version. This English version is provided for convenience only.
1. Service Provider Identification
In compliance with Spanish Law 34/2002 of July 11 on Information Society Services and Electronic Commerce (LSSI-CE), the provider of this service is:

2. Description of the Service
Rigels.io provides shared web hosting services to individuals and small businesses. Available plans are:

The specific features of each plan are detailed on the pricing page. All plans include NVMe infrastructure, automatic SSL certificates, corporate email, daily backups, and PHP support from version 5.6 to 8.5.
3. Contracting Conditions
3.1. To use the Service you must be at least 18 years old or have authorization from your legal representative.
3.2. By completing the registration and payment process, you declare that you have read and accepted these Terms and Conditions as well as the Privacy Policy.
3.3. The contractual relationship begins when payment is confirmed and the contracted service is activated.
4. Pricing, Billing and Payments
4.1. Prices are expressed in euros (€) and include applicable taxes under current Spanish legislation.
4.2. Billing is monthly and renews automatically unless the client cancels at least 48 hours before the renewal date.
4.3. Rigels.io reserves the right to modify its rates, notifying the client at least 30 days in advance by email.
4.4. Non-payment of fees may result in suspension of the service, with prior notice to the client.
5. Cancellation and Refund Policy
5.1. Service Cancellation
5.1.1. The client may cancel their subscription at any time from the user panel or by sending a request to hola@rigels.io.
5.1.2. After cancellation, access to the service will remain active until the end of the already paid period. No further charges will be generated from that date.
5.1.3. Cancellation must be requested at least 48 hours before the next renewal date to prevent the next billing cycle from being processed.
5.2. General Refund Conditions
5.2.1. As a general rule, no refunds will be issued for service periods already invoiced and rendered. The client contracts a continuous access service, not a product with an immediate right of withdrawal.
5.2.2. Exceptions in which Rigels.io may issue a full or partial refund:

Service interruption exceeding 72 consecutive hours directly attributable to Rigels.io (excluding external attacks, scheduled maintenance or third-party provider failures).

Verified billing error (duplicate charge, incorrect amount, etc.).

Technical inability to activate the contracted service within 5 business days of payment.
5.2.3. The client has a maximum of 7 calendar days from the payment date to submit a refund request, with the exception noted in section 5.3 for manual payments. After this period, no requests will be accepted except for verified billing errors.
5.2.4. Refund requests must be sent to hola@rigels.io with the subject "Refund Request – [order number]", detailing the reason and attaching the corresponding proof of payment.
5.2.5. Rigels.io will evaluate each request within a maximum of 5 business days and communicate the resolution to the client by email.
5.3. Refunds for Manual Payments (Bank Transfer and Mobile Payment)
5.3.1. Payments made by bank transfer or mobile payment (including payment methods common in Venezuela) are manually processed and verified by Rigels.io. Service activation is subject to confirmation of payment receipt.
5.3.2. The client has a maximum of 5 calendar days from the payment date to request a refund for manual payments. After this period, no request will be accepted under any circumstances, as manual processing will have been completed and the service activated.
5.3.3. The refund will be issued for the exact amount received in the original payment currency. No conversion to dollars, euros or any other currency will be applied. The client acknowledges that, upon receipt, the purchasing value of said amount may differ from that at the time of the original payment due to exchange rate fluctuations, a circumstance that Rigels.io cannot control or compensate.
5.3.4. Where a refund is approved, it will be issued exclusively to the bank account or phone number (mobile payment) expressly indicated by the payment holder. The account holder must be the same person who made the original payment; third-party accounts will not be accepted under any circumstances, as a fraud prevention measure.
5.3.5. The refund processing time for manual payments is 15 business days from approval of the request.
5.3.6. Manual payment refunds are subject to the following costs, which will be deducted from the amount to be returned:
- Bank transfer fee: the actual cost charged by the intermediary financial institution to process the refund.
- Administrative charge: 1% of the refunded amount, with a minimum of $1 USD and a maximum of $10 USD, for manual processing.
The client will receive the original payment amount minus the costs described above. Rigels.io will provide an exact breakdown before processing the refund.
5.4. Refunds for Card Payments (Stripe)
5.4.1. Payments processed by credit or debit card through the Stripe platform are subject to the general refund conditions in section 5.2, with a maximum request window of 7 calendar days from payment.
5.4.2. Where a refund is approved, the amount is returned directly to the original payment method (card used in the transaction). Rigels.io cannot redirect the refund to a different account or card; this is a technical limitation imposed by Stripe.
5.4.3. Stripe refunds are subject to the following costs, which will be deducted from the amount to be returned:
- Stripe processing fee: 1.4% of the original amount + €0.25 (standard rate for European cards). This fee is non-recoverable by Rigels.io and is passed on in full to the client.
- Administrative charge: 1% of the refunded amount, for processing.
Indicative example: for a €15 refund (Business plan), the deduction would be: €0.21 (1.4%) + €0.25 (Stripe fixed) + €0.15 (1% admin) = €0.61 total deduction. The client would receive €14.39.
5.4.4. The time for the refund to appear in the client's account depends on their bank and card type, and may take between 5 and 10 business days from the date Rigels.io issues the refund.
5.4.5. If the client opens a dispute or chargeback directly with their bank or card issuer without first contacting Rigels.io, Rigels.io reserves the right to submit evidence to Stripe to contest the dispute, and may suspend the associated service during the process.
5.5. Refunds for PayPal Payments
5.5.1. Payments made through PayPal are subject, in addition to this policy, to PayPal's Terms of Use.
5.5.2. Where a refund is approved by Rigels.io, the amount is returned exclusively to the PayPal account from which the original payment was made. PayPal does not technically allow refunds to be redirected to a different account.
5.5.3. As with Stripe, the processing fees charged by PayPal on the original transaction are non-recoverable and will be deducted from the refunded amount.
5.5.4. The client has the right to open a claim through the PayPal Resolution Centre within 180 days of the transaction. Rigels.io recommends contacting hola@rigels.io first to resolve the issue quickly before escalating to PayPal.
5.5.5. If a PayPal claim is opened without prior contact with Rigels.io, Rigels.io will actively cooperate in the resolution process and may suspend the associated service during its processing.
6. User Obligations and Acceptable Use
6.1. The user is solely responsible for the content hosted on Rigels.io servers and the activities carried out through the Service. By contracting, the user declares that they will make lawful, ethical use in compliance with Spanish and EU legislation.
6.2. Prohibited Content and Activities
The following activities are expressly prohibited:
a) Adult Content and Pornography
- Hosting, distributing or transmitting pornographic or sexually explicit content of any kind.
- Hosting child sexual abuse material (CSAM), which is a criminal offense under Spanish Penal Code Art. 189 and will be immediately reported to competent authorities (National Police, INTERPOL, NCMEC).
- Operating webcam platforms, OnlyFans clones or other adult content services without the required age verification and applicable legal licenses.
b) Cryptocurrency Mining (Cryptomining)
- Running cryptocurrency mining software (Bitcoin, Monero, Ethereum, etc.) on any Rigels.io servers or resources.
- Using the Service's computing resources (CPU, GPU, RAM, bandwidth) for blockchain generation, validation or any other operations that consume resources massively or continuously.
- Installing browser mining scripts that affect visitors of hosted websites.
Unauthorized cryptomining will result in immediate suspension without prior notice, given its direct impact on shared infrastructure.
c) Spam and Unsolicited Mass Email
- Sending unsolicited bulk email (spam) from corporate email accounts or servers associated with the Service.
- Using the Service as the source of phishing campaigns or email identity spoofing.
- Operating distribution lists, botnets or automated sending scripts without the express consent of recipients, in violation of CAN-SPAM, GDPR and the Spanish LSSI.
- Hosting email harvesting pages or forms designed for mass data collection without legal basis.
d) Fraud, Scams and Deceptive Activities
- Hosting websites that impersonate banks, payment platforms, official bodies or other companies to obtain personal or financial data from third parties (phishing and spoofing).
- Operating pyramid schemes, Ponzi schemes, fraudulent investments or any activity constituting fraud under Spanish Penal Code Art. 248 et seq.
- Distributing malicious software (malware, ransomware, spyware, keyloggers, trojans) or hosting command and control infrastructure (C2/C&C) for compromised computer networks (botnets).
- Hosting online stores with fraudulent intent or that fail to comply with e-commerce and consumer protection regulations.
e) Other Illegal or Harmful Activities
- Hosting or distributing content that incites hatred, violence or discrimination based on race, sex, religion, sexual orientation or other characteristics protected by Spanish law.
- Operating black markets or platforms for buying and selling illegal products or services (weapons, drugs, forged documentation, etc.).
- Carrying out denial of service attacks (DoS/DDoS), unauthorized vulnerability scanning (pentesting), or any activity that compromises the security of third parties.
- Infringing intellectual property rights: distributing software, music, films or other copyright-protected content without the rights holder's authorization.
- Using the Service for money laundering, terrorism financing or any activity subject to AML/CFT regulations.
6.3. Account Abuse and Multiple Plans
6.3.1. Creating multiple accounts or contracting several plans in order to circumvent restrictions, fraudulently accumulate resources or bypass these Terms is prohibited.
6.3.2. Rigels.io reserves the right to associate different accounts sharing the same IP address, payment method, email or registration data, and treat them as a single account if there is evidence of fraudulent use.
6.3.3. Resource abuse in shared environments (abnormal CPU, RAM, I/O or sustained bandwidth consumption) may result in temporary service suspension with notification to the client. In case of recurrence, Rigels.io may cancel the service permanently.
6.4. Consequences of Non-Compliance
6.4.1. Breach of any of the obligations in this section entitles Rigels.io to:

Suspend the service immediately and without prior notice when detected activity poses a direct risk to infrastructure, third parties or involves illegal activity.

Cancel the service permanently and without right to refund.

Report the activity to competent authorities (National Police, Spanish Data Protection Agency, Europol or other relevant bodies) when there is evidence of criminal activity.

Retain the client's data for as long as necessary to cooperate with ongoing judicial or police investigations.
6.4.2. Rigels.io shall not be liable for damages caused to third parties resulting from misuse of the Service by the client.
7. Service Availability (SLA)
7.1. Rigels.io commits to maintaining a monthly availability of 99.5% for its hosting services.
7.2. Scheduled maintenance periods (notified in advance) and interruptions caused by third parties or external attacks are excluded from this calculation.
7.3. In the event of serious incidents, Rigels.io will inform the client within a maximum of 4 hours from detection.
8. Limitation of Liability
8.1. Rigels.io shall not be liable for indirect damages, loss of profits or data loss arising from the use or inability to use the Service, except in cases of wilful misconduct or gross negligence directly attributable to Rigels.io.
8.2. Rigels.io's total maximum liability shall not exceed the amount paid by the client in the three (3) months prior to the event causing the damage.
8.3. The client is advised to maintain additional backups, without prejudice to the daily backups included in the service.
8.4. Backups: Rigels.io performs daily backups of hosted files. These backups are retained for 7 days and are intended solely for technical restoration. The client bears final responsibility for their own data and must maintain additional copies if required.
9. Intellectual Property
9.1. All elements of rigels.io (brand, logo, design, source code) are the property of Rigels.io or their respective owners and are protected by intellectual property law.
9.2. The client retains all rights to the content they host on Rigels.io servers.
10. Modifications to the Terms
Rigels.io may modify these Terms at any time, notifying the client at least 15 days in advance by email. Continued use of the Service after notification implies acceptance of the new terms.
11. Applicable Law and Jurisdiction
These Terms are governed by Spanish law.
- If the client is a business (B2B), the parties submit to the Courts of Vigo (Pontevedra), Spain.
- If the client is a consumer (B2C), the mandatory jurisdiction of their country of residence shall apply, in accordance with EU Regulation No. 1215/2012.
12. Privacy Policy
12.1. Data Controller
Personal data collected through rigels.io is processed by Carmine Maggio, based in Vigo, Spain, contact email: hola@rigels.io.
12.2. Data Collected and Purpose
We collect only the data strictly necessary for service provision:
- Identification and contact data (name, email): to manage your account and communicate with you.
- Payment data: processed by third-party payment gateways. Rigels.io does not store bank card data.
- Usage data and technical logs: to ensure the security and proper functioning of the infrastructure.
12.3. Legal Basis for Processing
Processing is based on contract performance (Art. 6.1.b GDPR) and, where applicable, on the legitimate interest of Rigels.io in maintaining service security (Art. 6.1.f GDPR).
12.4. Data Retention
Data will be retained for as long as necessary for service provision and, once cancelled, for legally required periods (maximum 5 years for tax and contractual data).
12.5. Recipients
Data will not be shared with third parties except by legal obligation or when necessary for service provision (infrastructure providers, payment gateways). All providers comply with GDPR.
12.6. User Rights
You may exercise your rights of access, rectification, erasure, objection, portability and restriction of processing at any time by contacting hola@rigels.io. You also have the right to lodge a complaint with the Spanish Data Protection Agency (AEPD) at www.aepd.es.
13. Cookie Policy
13.1. What Are Cookies?
Cookies are small text files stored on your device when you visit a website. They allow the site to remember information about your visit, such as language preferences or whether you are logged in, in order to improve your experience on future visits.
13.2. Legal Basis
Cookie use on rigels.io is governed by:
- EU Regulation 2016/679 (GDPR) for cookies involving personal data processing.
- Spanish Law 34/2002 (LSSI-CE), Art. 22.2, which requires informed user consent for non-essential cookies.
- AEPD guidelines on cookie use (2023 update).
Technical or essential cookies do not require consent as they are essential for service operation. All others require your explicit acceptance.

13.5. Third-Party Cookies
Rigels.io integrates third-party services that may set their own cookies. Rigels.io has no control over these cookies and we recommend consulting each provider's privacy policy:

13.6. Managing and Withdrawing Consent
You can manage your cookie preferences at any time:
- From the cookie banner on rigels.io, available when you first visit the site or by clicking the "Manage cookies" link in the footer.
- From your browser settings: all modern browsers allow you to view, block or delete stored cookies.
- By withdrawing consent: you may withdraw your consent at any time with future effect. Withdrawal does not affect the lawfulness of processing based on consent before its withdrawal.
Please note that disabling technical cookies may prevent the platform from working correctly, including login and payment processes.
13.7. Cookie Data Retention
Data from analytics cookies is stored in an anonymized and aggregated form. No cookie is used to build individual behavioral profiles without the user's explicit consent. Consent records are retained for the legally required period as evidence of compliance.
14. Technical Support
Support is offered exclusively by email. A response is guaranteed within 24 business hours, although in practice it is usually much faster. Support for the client's custom code is not included, except in Business plans.
